Kittl Design Challenges | T&C

The Challenge is open to individuals who are 18 years of age or older at the time of entry. The Challenge is void where prohibited by law.

Employees of Kittl (HTC Heritage Type GmbH), its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members as well as those of any partner brands connected to the challenge are not eligible to participate.

Participants are responsible for ensuring that participation is legal in their country of residence.

By participating in this Challenge, you agree to be fully bound by these Official Rules and represent that you meet all eligibility requirements.

Kittl reserves the right to disqualify any participant who violates these rules.

Entries must be submitted by the deadline stated in the official Instagram post or challenge description page.

Late submissions will only be considered only at the discretion of Kittl.

Winners will be announced on the date specified in the challenge description.

To participate:

Entries must:

• Comply with Instagram community guidelines and applicable laws

Entries containing unlawful, offensive, violent, discriminatory, or sexually explicit content will be disqualified.

Only one entry per participant unless otherwise stated.

Winners will be selected by a jury consisting of representatives from Kittl and, where applicable, the brand partner.

Entries will be judged based on:

• Interpretation of the brief
• Concept and originality
• Visual appeal
• Technical execution

All decisions by the jury are final and binding.

6.1 Prize Description

The prizes are described in the official Challenge announcement or description page. The number of winners and the type of prize (cash payment, gift card, promo code, or other reward) will be specified therein.

Prizes are non-transferable and may not be substituted or exchanged, except at Kittl’s sole discretion. Kittl reserves the right to substitute a prize of equal or greater value if a stated prize becomes unavailable.

6.2 Winner Notification and Acceptance

Winners will be notified via direct message, email, or other contact method used for entry.

Winners must respond and accept the prize within 7 days of notification (or such other timeframe stated in the Challenge announcement). Failure to respond within the specified timeframe may result in forfeiture of the prize, and Kittl may select an alternate winner.

6.3 Verification and Compliance

Prize claims are subject to verification of eligibility and compliance with these Official Rules.

If the prize includes a monetary payment, winners may be required to:

• Complete identity verification
• Provide tax documentation (e.g., W-8BEN, W-9, or equivalent)
• Submit accurate payment information
• Complete onboarding through Kittl’s designated payment provider

Kittl reserves the right to withhold or refuse payment if required documentation is not provided, incomplete, or inaccurate.

6.4 Payment Processing (Tipalti or Equivalent Provider)

Cash prizes will be paid exclusively through Kittl’s designated third-party payment provider (currently Tipalti or a comparable provider).

Winners must complete the provider’s onboarding and compliance procedures before payment is released. Payment processing times may vary depending on jurisdiction and verification requirements.

Kittl is not responsible for:

• Delays caused by incomplete verification
• Incorrect payment information submitted by the winner
• Bank processing delays
• Currency exchange rate fluctuations
• Transaction or bank fees imposed by third parties

Payments may not be available in certain jurisdictions due to legal or compliance restrictions.

6.5 Gift Cards and Non-Cash Prizes

If a prize consists of a gift card or voucher:

• It may be subject to additional terms and conditions of the issuing provider.
• It may not be redeemable for cash unless required by law.
• Expiration dates and usage limitations may apply.
• Currency and regional restrictions may apply.

Kittl is not responsible for lost, stolen, expired, or unused gift cards once delivered.

6.6 Taxes

Winners are solely responsible for any federal, state, local, or international taxes, duties, or other governmental charges associated with receiving a prize.

Kittl may be required to collect tax information or report payments to applicable tax authorities. Where required by law, Kittl may withhold applicable taxes from the prize amount.

6.7 Disqualification and Forfeiture

Kittl reserves the right to disqualify any participant or revoke any prize if:

• The participant violates these Official Rules
• Fraudulent, deceptive, or abusive behavior is detected
• The submission infringes third-party rights
• Required documentation is not provided within the specified timeframe
• The winner is located in a jurisdiction where the Challenge or prize distribution is prohibited

6.8 Sanctions and Export Compliance

Prizes will not be awarded to individuals:

• Located in countries subject to international sanctions or embargoes
• Listed on applicable sanctions or restricted party lists
• Otherwise prohibited by applicable export control or trade compliance laws

Kittl reserves the right to conduct compliance screening prior to awarding any prize.

6.9 Publicity

By accepting a prize, winners agree that Kittl may use their name, username, likeness, and submission content for promotional and marketing purposes worldwide without additional compensation, unless prohibited by law.

By entering, you grant Kittl and its brand partners the right to:

• Share, repost, and promote your submission.
• Use your name and/or username in connection with the Challenge
• Kittl will contact participants for further permissions to feature submissions in marketing, promotional, and educational materials

You retain ownership of your design, but grant Kittl a non-exclusive, royalty-free license to use the submitted content for promotional purposes.

You represent and warrant that your submission:

• Is your original work
• Does not infringe on third-party rights
• Does not contain unauthorized copyrighted material

Kittl reserves the right to disqualify any participant who:

• Uses fraudulent methods
• Attempts to manipulate results
• Violates Instagram policies
• Violates these Official Rules

By participating, you release Kittl and its partners from any liability arising from participation in the Challenge or acceptance of any prize.

Kittl is not responsible for technical issues, internet failures, lost submissions, or platform interruptions.

This Challenge is in no way sponsored, endorsed, administered by, or associated with Instagram.
